These Terms & Conditions (“Terms”) govern all transportation services, reservations, quotations, bookings, and related services provided by Daniel’s Limousine (“Daniel’s Limousine,” “Company,” “we,” “us,” or “our”).
By requesting a quote, making or confirming a reservation, electronically accepting these Terms, or using our transportation services, the person making the reservation (“Customer,” “you,” or “your”) agrees to these Terms on behalf of themselves and, where applicable, all passengers included in the reservation.
Please read these Terms carefully before completing a reservation.
1. Reservations and Acceptance
A request for transportation does not constitute a confirmed reservation until Daniel’s Limousine accepts the reservation.
We may decline or cancel a reservation before service when reasonably necessary because of vehicle availability, incorrect booking information, payment authorization issues, safety concerns, operational limitations, or circumstances beyond our reasonable control.
The individual making a reservation represents that they are at least 18 years old and have authority to enter into the reservation and accept these Terms.
If a reservation is made on behalf of another person or group, the person making the reservation is responsible for communicating applicable reservation requirements and policies to the passengers.
2. Accuracy of Reservation Information
Customers are responsible for providing complete and accurate information, including:
- Passenger name and contact information;
- Pickup and destination addresses;
- Pickup date and time;
- Flight information, when applicable;
- Number of passengers;
- Number and approximate size of luggage items;
- Stops or itinerary requirements;
- Special transportation requirements; and
- Any other information reasonably necessary to provide the service.
Daniel’s Limousine is not responsible for delays, additional charges, missed pickups, or inability to perform service caused by inaccurate, incomplete, or untimely information supplied by the Customer.
Customers should promptly notify us of any changes.
3. Vehicle Selection and Substitution
Vehicle descriptions, photographs, makes, models, model years, colors, and interior configurations displayed on our website are illustrative of the vehicle class or service offered unless a specific vehicle is expressly guaranteed in writing.
We may substitute a comparable or higher-class vehicle when reasonably necessary because of mechanical issues, maintenance, scheduling, safety concerns, emergencies, or other operational requirements.
A substitution will not by itself constitute a failure to provide the reserved transportation service when the substituted vehicle reasonably accommodates the confirmed passenger and luggage requirements.
4. Passenger and Luggage Capacity
Customers must accurately disclose the number of passengers and luggage items before booking.
Published capacities represent maximum permitted or practical capacities and may vary depending on luggage size, passenger needs, equipment, or the particular vehicle assigned.
The chauffeur may refuse to transport passengers or luggage exceeding the safe or lawful capacity of the assigned vehicle.
If the reservation cannot be performed because the Customer provided inaccurate passenger or luggage information, applicable cancellation or no-show charges may apply.
5. Pricing
The price displayed during booking is based on the service type, vehicle, route, mileage, duration, pickup time, and other information provided when the reservation is made.
Daniel’s Limousine currently applies a 3.5% booking fee to reservations.
Optional gratuity may be selected by the Customer. Gratuity is not mandatory unless expressly disclosed for a particular reservation.
Where applicable, additional amounts permitted under the reservation may arise from customer-requested changes, additional authorized service, waiting time, cancellation, no-show, or other charges specifically disclosed under these Terms or an incorporated policy.
6. Early Pickup Fee
For applicable Sedan and SUV point-to-point reservations with pickup times between 12:00 A.M. and 4:59 A.M., a $20 early pickup fee may apply.
7. Waiting Time
Sedan and SUV reservations include the first 15 minutes of applicable waiting time without additional charge. After that period, waiting time may be charged at $1.00 per minute.
Sprinter Van and Stretch Limousine reservations include the first 15 minutes of applicable waiting time without additional charge. After that period, waiting time may be charged at $2.00 per minute.
Airport and cruise transportation may use separate pickup and waiting procedures because arrival times, baggage collection, customs, terminal access, and port or airport operations can affect pickup timing.
8. Cancellations and No-Shows
All reservations are subject to the Company’s separately posted Cancellation & No-Show Policy.
Sedan and SUV reservations:
- More than 3 hours before pickup: no cancellation charge;
- 1 to 3 hours before pickup: 50% of the applicable reservation amount;
- Less than 1 hour before pickup: 100% of the applicable reservation amount;
- No-show: 100% of the applicable reservation amount.
Sprinter Van and Stretch Limousine reservations:
- More than 48 hours before pickup: no cancellation charge;
- 24 to 48 hours before pickup: 50% of the applicable reservation amount;
- Less than 24 hours before pickup: 100% of the applicable reservation amount;
- No-show: 100% of the applicable reservation amount.
9. Changes to Reservations
Changes to pickup time, date, locations, vehicle class, stops, service duration, passenger count, or itinerary are subject to availability.
A requested modification may change the price. No modification is effective until confirmed by Daniel’s Limousine.
10. Payment Method and Card Authorization
A valid payment method may be required to secure a reservation.
Payment card information used through our booking system is processed through our payment service provider, currently Square. Daniel’s Limousine does not intend to independently store raw card numbers or card security codes when those credentials are handled by Square.
For completed transportation services, the applicable reservation charge will ordinarily be processed after the trip has been completed.
The payment method may also be charged for amounts authorized under the reservation and applicable policies, including applicable cancellation, no-show, or waiting-time charges.
11. Customer Conduct and Safety
Passengers must comply with reasonable safety instructions from the chauffeur.
- Threatening, abusive, violent, or harassing behavior is prohibited;
- Illegal activity is prohibited;
- Smoking or vaping may be prohibited;
- Passengers may not interfere with the chauffeur’s operation of the vehicle;
- Passenger capacity may not be exceeded.
Daniel’s Limousine may refuse or terminate transportation when continuing service would reasonably create a safety, legal, or security risk.
12. Vehicle Damage and Excessive Cleaning
The Customer is responsible for damage caused by the intentional, reckless, or negligent acts of the Customer or passengers in their party.
The Customer may also be responsible for reasonable cleaning costs resulting from spills, bodily fluids, smoking residue, or other substantial contamination beyond ordinary use.
13. Delays and Circumstances Beyond Our Control
Daniel’s Limousine makes reasonable efforts to provide timely transportation but does not guarantee arrival times when performance is affected by circumstances outside our reasonable control, including traffic, road closures, accidents, severe weather, flooding, airport or port congestion, security restrictions, government actions, major events, mechanical emergencies, outages, labor disruptions, or other uncontrollable events.
14. Flights, Cruises, Appointments, and Other Time-Sensitive Events
Customers are responsible for allowing sufficient travel time for flights, cruises, appointments, meetings, events, and other scheduled activities.
To the fullest extent permitted by law, Daniel’s Limousine is not responsible for consequential economic losses resulting solely from circumstances outside our reasonable control.
15. Personal Property
Passengers are responsible for their personal property.
Daniel’s Limousine will make reasonable efforts to identify and return property found in a vehicle, but recovery is not guaranteed.
16. Communications
By making a reservation, the Customer agrees that Daniel’s Limousine may contact the Customer by phone, text message, or email for reservation confirmations, chauffeur details, pickup information, trip changes, payment information, receipts, and other communications necessary to provide the service.
17. Third-Party Services
Certain portions of our services may rely on third-party payment processors, mapping providers, communications providers, hosting companies, and other vendors.
18. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
To the fullest extent permitted by applicable law, Daniel’s Limousine will not be liable for indirect, incidental, special, exemplary, or consequential economic damages arising from circumstances outside our reasonable control.
19. Customer Responsibility for Their Party
The person making the reservation is responsible for complying with these Terms and for the reasonable conduct of passengers traveling under the reservation.
20. Website Information
Typographical errors, technical errors, outdated content, or obvious pricing errors do not create a right to transportation at an erroneous price.
21. Privacy
Personal information collected through our website or reservation process is handled in accordance with our Privacy Policy.
22. Electronic Agreement and Records
The Customer agrees that these Terms and related policies may be presented and accepted electronically.
Checking an agreement box or electronically submitting a reservation after being presented with the applicable terms may constitute evidence of agreement to those terms.
23. Governing Law
These Terms and reservations with Daniel’s Limousine are governed by the laws of the State of Texas, except where federal law or another applicable law controls.
24. No Waiver
Failure by Daniel’s Limousine to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision.
25. Severability
If any provision is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.
26. Entire Agreement and Incorporated Policies
These Terms, together with the reservation confirmation and incorporated policies, constitute the agreement governing the reservation.
27. Changes to These Terms
Daniel’s Limousine may update these Terms from time to time. The version applicable to a reservation is generally the version presented or in effect when the reservation is confirmed.
